This policy applies to all authorized operations of the Service by any of these entities. Any reference to "we," "us," or "our" includes all subsidiaries and affiliates of GemIQ.
1. INFORMATION WE COLLECT ABOUT YOU
We collect data you put into our systems when you use our Services or our Apps, and for any other matter in relation to the Services. Whenever a user interacts with or creates an account for the Services, GemIQ collects different kinds of data to be able to provide the Services available. Such information can be as follows:
a. Personal Information You Provide
We may collect personal information, including but not limited to your name, email address, contact details, payment information, and other business details when you register, access, or utilize our Services. This data is sent by you to GemIQ to register an account or to access and use the Services. You may do so directly or you may choose to disclose such information through a third party. The data you decide to disclose and enter is stored by us on our servers and cloud systems. This information may include, but shall not be limited to: Name, Age/Birthday dates, Email Address, Location, Password, Gender, Telephone numbers, Descriptions, and Payment Information.
b. Biometric Data
GemIQ operates a SaaS jewelry available through mobile devices, tablets, computers, and other consumer electronics (the "Virtual Try-On Service"). This policy encompasses any biometric data collected through our Apps for this Virtual Try-On Service, including scans of your face and body parts (e.g., hand, ear, neck) for personalized services. We do not use facial recognition technology for identification purposes. We will not store your biometric data after your Virtual Try-On Service session ends.
c. Information We Collect Automatically (Non-Identifiable Information)
This kind of information is data collected from Users automatically when they use our Site or Apps, regardless of them being logged in or not. The information is generally Non-Identifiable, which means that we typically cannot or would not be able to identify a particular User with such data without cross-referencing other information. Data gathered in this category includes but is not limited to:
IP Address
Device type and unique device identifier
Browser type and plugin details
Language preference
Time zone
Screen size
Operating System
Referrer URL
Location (e.g., inferred zip code or area code)
Details of how you use our Site and Services. Except in limited instances to ensure the quality of our Services over the Internet, such information will generally not be associated with your IP address. We may collect information regarding customer activities on our websites and platforms, which is used to understand which parts of our Website and Services are of most interest. This data may be aggregated and thus is considered non-personal information for some purposes of this Privacy Policy.
The way this data is gathered is mainly from cookies, beacons, and third-party service logs and analytics tools.
d. Images and User-Generated Content
Our Services, such as removing backgrounds from images, require you to submit images or other content ("Submitted Images"). When you upload images, we collect that content to perform the requested service.

a. Performing, Improving, and Developing our Services
Delivering the information and support you request, including technical notices, security alerts, and support and administrative messages such as to resolve disputes, collect fees, and provide assistance for problems with our Services.
Determining whether the Services are available in your country or location.
Developing new products and services.
Training our Jewelry Intelligence models to enhance and develop our Services, including improving existing features (such as image processing and virtual try-on capabilities) and creating new functionalities. This may involve using various types of data collected from you, including images you submit, your usage patterns, and metadata, as further detailed in our Terms of Service. Where feasible and appropriate, we will use anonymized or aggregated data for Jewelry Intelligence training purposes.
Displaying your historical transaction or appointment information (if applicable).
Improving, personalizing, and facilitating your use of our Services.
Processing or recording payment transactions.
Providing, maintaining, and improving our Services, which could include analytics information.
Doing internal research, measuring, tracking, and analyzing trends and usage.
Otherwise providing you with GemIQ products and features you choose to use.

The length of time a cookie will stay on your Browse device depends on whether it is a "persistent" or "session" cookie.
Session cookies will only stay on your device until you close your browser.

For example, we may share your information internally to understand how you engage with GemIQ products to help make our Services better for you and for everyone and to help us build Services tailored to your preferences.
With our Service Providers: With service providers who help us provide, maintain, and improve our Services, partners, and other entities that help us provide the Services (e.g., payment processors, data analytics providers, cloud hosting services).
Business Transfers and Corporate Changes:

Aggregated and Anonymized Information: GemIQ may share (within our group of companies or affiliates, or with service providers or other third parties) aggregated and anonymized information that does not specifically identify you or any individual user of our Services. This non-personal data may be shared with affiliates and partners but will not include any identifiable information.
We will not sell your personal information in the traditional sense without your explicit consent.
6. HOW LONG WE KEEP YOUR INFORMATION
We generally keep your information as long as reasonably necessary to provide you the Services or to comply with applicable law. However, even after you deactivate your account or discontinue using the Services, we can retain copies of information about you and any transactions or Services in which you may have participated for a period of time that is consistent with applicable law, applicable statute of limitations or as we believe is reasonably necessary to comply with applicable law, regulation, legal process, or governmental request, to detect or prevent fraud, to collect fees owed, to resolve disputes, to address problems with our Services, to assist with investigations, to enforce our Terms of Service or other applicable agreements or policies, or to take any other actions consistent with applicable law.
7. YOUR DATA CHOICES AND RIGHTS
a. Personal Information
You may access, change, or correct information that you have provided by logging into your GemIQ account at any time or by making a request to us at support@gemiq.com. We will need to verify your identity before granting access or otherwise changing or correcting your information.
b. Location Information
In order to provide certain Services, we may request access to location information, including precise geolocation information collected from your device. If you do not consent to the collection of this information, certain Services will not function properly and you will not be able to use those Services. You can stop our collection of location information at any time by changing the preferences on your mobile device. If you do so, some of our mobile applications will no longer function. You also may stop our collection of location information via mobile application by following the standard uninstall process to remove all GemIQ mobile applications from your device.
c. Promotional Communications
You can opt out of receiving promotional messages from GemIQ by following the instructions in those messages (e.g., using the 'opt-out' or 'unsubscribe' link), by informing the caller that you would not like to receive future promotional calls, or by changing your notification settings by logging into your GemIQ account (if available). Opting out of receiving communications may impact your use of the Services. If you decide to opt out, we may still send you non-promotional communications, such as digital receipts and messages about your account or our ongoing business relations.
d. Rights of California Residents
If you are a California resident, GemIQ, to the extent required by any applicable law, will disclose, delete, or take any other action with respect to any of your personal data that is collected by us. Residents of California may make a request pursuant to the California Consumer Privacy Act (CCPA) / California Privacy Rights Act (CPRA) to have us, among other things:

The purposes for our collecting such personal data.

Limit the use and disclosure of sensitive personal information (if collected and applicable). Any such request by an individual under California law (1) can, for certain requests, only be made twice in a 12-month period, (2) will require the collection of certain information by us to verify the identity of such individual, and (3) can be submitted to us by contacting support@gemiq.com. We will respond to any such request within 45 days after receiving it, though this period may be extended once by an additional 45 days when reasonably necessary. We will not discriminate against any individual for exercising any right made available to such individual under California law.
e. European Privacy Rights (EEA, UK, Switzerland)
Subject to certain limitations and exceptions, if you are in the European Economic Area (EEA), the United Kingdom (UK), or Switzerland, you have the following rights under applicable data protection laws (such as the GDPR):
Access to personal data: This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.

8. CHILDRENʼS PERSONAL INFORMATION
Our Services are general audience services not directed at children under the age of 13 (or a higher age threshold where applicable local law requires). If we learn that any information we collect has been provided by a child under the applicable age threshold without verified parental consent, we will promptly delete that information.
9. HOW WE SECURE INFORMATION
We take reasonable measures, including administrative, technical, and physical safeguards, to protect your information from loss, theft, and misuse, and unauthorized access, disclosure, alteration, and destruction. We maintain strict control over the confidentiality of your information.
Nevertheless, the internet is not a 100% secure environment, and we cannot guarantee absolute security of the transmission or storage of your information. We hold information about you both at our own premises and with the assistance of third-party service providers.
While GemIQ strives to keep the Service available 24/7, there may be occasions when interruptions occur due to upgrades, emergency repairs, or telecommunications issues beyond our control. We will take all reasonable steps to minimize disruptions. You agree that GemIQ shall not be liable for any modifications, suspensions, or discontinuations of the Service impacting data access, subject to our obligations under applicable law.
10. STORAGE AND PROCESSING
We may, and we may use third-party service providers to process and store your information in the United States, Canada, the European Union, and other countries. This may be outside the country where you live. When we transfer personal information to other countries, we will ensure that appropriate safeguards are in place to protect your information.
11. USE OF IMAGES SENT TO US FOR OUR SERVICES
The Site and Apps offer services such as removing backgrounds from images submitted by customers ("Submitted Images"). We will not use these Submitted Images for our own private or commercial purposes (other than to provide the requested Service to you and for Jewelry Intelligence training as detailed in our Terms of Service and this Privacy Policy) without your prior consent. Processed images will be available at a public URL for your access; however, this URL will not be actively published by us to the general public. We urge you to use discretion when sending images that may contain sensitive information. GemIQ is not liable for unauthorized transmissions of images that do not belong to you.
12. LINKS TO OTHER SITES
You may encounter links to other sites while using our Site or Apps. We recommend reviewing their privacy policies, as they may differ from ours. We are not responsible for the privacy practices or content of these linked sites.
13. CHANGES TO THIS PRIVACY POLICY
GemIQ reserves the right to, and may from time to time, make changes to this Privacy Policy. If this policy changes, the revised policy will be posted on the GemIQ home page or within our Services, and the "Last Updated" date at the top of this Privacy Policy will be revised. We encourage you to check this policy on the site frequently. Your continued use of GemIQ Services after any change in this Privacy Policy will constitute your acceptance of such change, except where further steps (such as explicit consent) are required by applicable law.
